The 2017 Tax Cuts and Jobs Act created one of the most exciting and controversial tools for community development seen in decades: the Opportunity Zones tax incentive for investment of capital gains in designated Opportunity Zones across the country. In Florida, 427 census tracts were designated, with at least one Opportunity Zone in every county. The incentive offers exceptional benefits for investors but comes with few regulations and no specific requirements for community benefit. As professionals across the nation grapple with the implications of the incentive, Florida’s cities and counties must understand how it works and how to ensure both communities and investors benefit.
